No. 209. AN ACT To authorize the erection of a lock-up house in the borough of Birmingham, and to collect certain taxes in said borough. SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the burgess and town council of the borough of Birmingham, in the Borough of Birmcounty of Allegheny, be and they are hereby authorized and empow-ingham to provide ered to furnish materials and build, or otherwise provide and support, a lock-up house. in or near to said borough, at the expense of said borough, a suitable house for the security and temporary detention of persons committed by justices of the peace of said borough and vicinity, and by the burgess of said borough, or member of the town council acting in his place, for any violation of the laws of this commonwealth, or of the ordinances of said borough, for which such person or persons could lawfully be committed to the common prison of said county, there to remain and be kept until such offender or offenders can be removed to the common jail of said county, if committed for an indictable offence, or can be discharged according to law: Provided, That no person shall be confined in said house, at any one time for a longer period than twenty-four hours, except such person be charged with an indictable offence, and it be necessary to detain him for examination. SECTION 2. That the expenses of committing and keeping any person Expenses. or persons in said house, on a charge of any indictable offence, shall be paid by the said county of Allegheny, on the presentation of proper accounts of the same to the commissioners of said county. property and subject to taxation. SECTION 3. That all dogs kept and owned by any inhabitant of the borough of Birmingham, in the county of Allegheny, within the limits Dogs to be deemed personal of said borough, shall be deemed personal property, and subject to taxation for the use of said borough; and it shall be the duty of the town council of said borough, annually, to issue their precept to the constable of said borough, authorizing and requiring him to enumerate, and return to the said council, within twenty days thereafter, the names of all the inhabitants of said borough who own or keep any dog or dogs, designating the number kept or owned by each; whereupon, the said town council shall proceed to levy and assess, on every such owner or keeper as aforesaid, a tax not exceeding one dollar for the first dog, two dollars for the second dog, and so on in proportion to the number of dogs owned or kept by such inhabitant, which said taxes shall be enforced and collected in the same manner as other taxes are collected by the said borough. Collection of SECTION 4. That the taxes imposed on real and personal property in the borough of Birmingham, Allegheny county, for borough purposes, taxes. and the fine imposed and levied for the breach of the ordinances of said borough, may be sued for and recovered by the said borough, in like manner as debts of the same amount are recoverable under the laws of this commonwealth. Execute deed. Proviso. Security. No. 210. AN ACT To enable the executor of Marion Pride, deceased, to sell and convey certain real estate. SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Walter H. Lowrie, acting executor of the last will and testament of Marion Pride, late of Allegheny county, deceased, be and he is hereby authorized to sell, either at public or private sale, and convey, in fee simple, all the right, title and interest of the said Marion Pride, deceased, at the time of her death, of, in and to all that certain lot or piece of ground, situate in the city of Pittsburg, and being part of lot number two hundred and five, in Colonel Wood's plan of said city, containing twenty-four feet front on First street, and extending in depth seventy-six feet, and adjoining property of Joseph Coltart and William Dilworth; and to make and execute to the purchaser or purchasers thereof, good and sufficient conveyances and assurances in law for the same, which said conveyances and assurances shall vest in such purchaser or purchasers, all the right, title and interest in law and equity. which the said Marion Pride, at and immediately before her death had and held in the same, as fully and completely, and with like effect, as if the said conveyances and assurances had been made and executed by the said Marion Pride, in her lifetime; and the moneys arising from such sale shall be safely loaned by the said executor, and the interest from the proceeds of such sale shall, semi-annually, be paid over by said execu tor to Sarah Scott, devisee in said will for her own proper support and disposal, for and during her natural life: Provided, That before executing and delivering any conveyance for said real estate, said executor shall give security, to be approved by the orphans' court of Allegheny county, in such amount as said court may direct, conditioned for the safe investment of the proceeds of said real estate, and the faithful application of the interest arising therefrom to the said Sarah Scott as aforesaid, and for the payment of the principal, after the decease of the said Sarah Scott, as directed by the will of the said Marion Pride, de ceased, or to those entitled to it by the laws of this commonwealth : APPROVED-The eighth day of March, one thousand eight hundred and forty-seven. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That James Carothers, of Wilkins township, Allegheny county, guardian of Authority to sell. Mary Elizabeth Agnew, be and is hereby authorized to sell and convey certain undivided real estate, being part in Allegheny, Northumberland and Schuylkill counties; that the said guardian may sell and convey all the interest said minor has in either of the above counties, or all the interest in the above named three counties, if he, in his judgment, deems it best for said minor; the orphans' court of Allegheny county to require sufficient bail from said guardian for the faithful performance Security. of the power herein vested in him, before the approval of said sale by the said court: Provided, That the said sale or sales shall be approved Proviso. by said court, before any deed shall be executed: Provided further, Proviso. That the proceeds of said sale shall be invested for the benefit of the said minor, by said guardian, under the direction and with the approval of said orphans' court. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Time extended. the provisions of an act of the general assembly of this commonwealth, entitled "An Act authorizing the governor to incorporate the Warren and Pine Grove railroad company," approved the fourteenth day of March, one thousand eight hundred and thirty-six, be and the same are hereby revived; and the time for commencing said railroad shall be three years, and the completing the same ten years from and after the passage of this act. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That President judge it shall be lawful for the president judge of the ninth judicial district of of ninth judicial Pennsylvania, on the request of the president judge of the twelfth judistrict may hold dicial district, to hold courts of common pleas at Harrisburg, for the courts of common county of Dauphin, from time to time, for the trial of civil causes; and pleas in Dauphin the list of causes for trial at such courts, shall be formed as may be county. ordered by the president judge of the said twelfth judicial district; and the venire for a jury for such courts, shall be issued and executed, in all respects, as in the case of courts to be held by the proper president judge of the said twelfth district; and all proceedings had before any court of common pleas held, as aforesaid, shall be of the same force and effect, to all intents and purposes, as if the same were had before the proper president judge of the said twelfth judicial district, and shall, in like manner, be subject to appeal, writ of error or execution in due course of law, as in other cases. Lower Mount Bethel township, in the county of Northampton, and for other purposes," approved the third day of April, one thousand eight hundred and forty six, as relates to the said township of Lower Mount Bethel, be and the same is hereby repealed.
