Orphans' court authorized to grant a sale.

No. 53.

AN ACT

Authorizing Joel Maxon, guardian of Benjamin M. Gibson, minor child of Benjamin Gibson, late of Fayette county, deceased, to sell certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That upon the petition of Margaret Bute, late widow of Benjamin Gibson, late of Union township, Fayette county, deceased, the orphans' court of said county are hereby authorized to grant an order to Joel Maxon, the aforesaid guardian, to sell, at public sale, and execute a good and clear title to the purchaser in fee simple therefor, all that certain tract or parcel of land, situate in Union township, Fayette county, of which the said Benjamin Gibson died seized, and invest the proceeds of said sale, to be held on the same trusts by the said guardian, for the use of the said widow and heir, in like manner as similar property is held by guardians under the intestate laws of this commonwealth Provided, That before such sale shall be made, the said guardian shall give a bond to the commonwealth, for the use of the persons interested, with such securities and in such penalty as the said court shall approve, conditioned for the faithful execution of the authority hereby given, and the investment of the said proceeds of the said sale, under the direction and with the approval of the said orphans' court.

No. 54.

AN ACT

To enable the executors of William Logan, to mortgage and improve certain real

estate.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Charles Oliver Logan and William Logan, surviving executors of the

last will and testament of William Logan, late of the city of Philadelphia, silk dyer, deceased, be and they are hereby authorized and empowered to raise, by mortgage of all or any part of the real estate of said decedent, such sum or sums of money as they may deem necessary, and to expend the same in satisfying the debts due and owing by the decedent in his life time, and by his representatives since his decease; and also in improving and repairing the buildings, and in erecting new buildings upon the real estate of the said decedent: Provided, That no money so to be raised by such mortgage, shall be paid to the said executors, or the survivor of them, until they or he shall have given sufficient security, to be approved by the orphans' court of said city and county, conditioned for the faithful application of such moneys, pursuant to the terms of this act.

No. 55.

AN ACT

In relation to courts of appeal and board of revision in Tioga county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assem

bly met, and it is hereby enacted by the authority of the same, That Courts of appeal hereafter it shall not be the duty of the commissioners of Tioga county, to be held in comto hold courts of appeal in the several townships and boroughs of said missioners' office. county, but the same may be held at the commissioners' office in said

county.

SECTION 2. So much of the act of the twenty-seventh July, eighteen hundred and forty-two, as requires that the board of revision should be sworn before and by the president judge, is hereby repealed, as far as relates to Tioga county; which board of revision in said county may hereafter be sworn before any person qualified to administer oaths by the laws of this commonwealth.

No. 56.

AN ACT

To regulate the holding of courts in Juniata county.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the first day of August, one thousand eight hundred and forty-seven, no venire shall issue in the county of Juniata, for the summoning of a petit or grand jury for the February term of the several courts of said county; and so much of the twenty-ninth section of the act, entitled "An Act relative to the organization of the courts of justice," passed April fourteenth, eighteen hundred and thirty-four, as is hereby altered or supplied, is hereby repealed.

No. 57.

AN ACT

To authorize Harriet Coleman to sell certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Harriet Coleman, guardian of Anna Coleman, Sarah Coleman and Harriet Coleman, minor children of James Coleman, late of the county of Lancaster, deceased, is hereby authorized and empowered to sell, either publicly or privately, convey and assure all the right, title and interest of the said minor children, of, in and to the whole or any part or parts of a certain plantation, or two contiguous tracts of land, with the hereditaments and appurtenances to the same belonging or appertaining, situ ate in the counties of Lancaster and Berks, whereof the said James Coleman died seized, in his demesne as of fee, the said tracts of land being the same which Henry Binckley and Elizabeth, his wife, by indenture, dated the first day of June, Anno Domini one thousand eight hundred

and eight, granted and conveyed to Robert Coleman in fee: Provided, Proviso. That no sale shall be made by her until she shall have given such security as the orphans' court of Lancaster county shall direct, for the faithful execution of the power committed to her, and for the due application, according to law, of the proceeds of such sale or sales.

AN ACT

Relating to road damages in Colebrookdale township, Berks county.

SECTION 1. Be it enacted by the Senate and House of Representa lives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the second section of the act, entitled "An Act relating to views of roads and damages in the counties of Monroe and Montgomery, and for other purposes," approved the seventh day of April, one thousand eight hundred and forty-five, be and the same is hereby repealed.

Preamble.

No. 59.

AN ACT

To authorize Susan S. Rambo, executrix of Ivins Rambo, deceased, to sell certain real estate.

WHEREAS, Ivins Rambo, late of Montgomery county, deceased, by his last will and testament, devised to his widow, Susan S. Rambo, a certain tract of land, situate in Upper Marion township, in said county, during her widowhood, containing one hundred and four acres of land; after which the same descends to an only child, now about ten years of age:

And whereas, A part of the wood of said tract, about ten acres thereof, is old and decaying, and is thought would be an advantage to the estate if the same was sold off, and the land brought under cultivation; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Authority to sell. Susan S. Rambo, executrix of Ivins Rambo, late of Montgomery county, deceased, be and she is hereby authorized and empowered to sell and dispose of, at public or private sale, the wood now standing upon ten acres of the real estate left by the said Ivins Rambo, deceased, upon such terms and conditions as she shall think right: Provided, The sale thus made shall be approved and confirmed by the orphans' court of said county: And provided further, That before confirmation of said sale, the said executrix shall give security, to be approved by the court, for the legal distribution of the proceeds of said sale.
