The Committee on Commerce, to whom was referred the bill (S. 3157) to authorize the construction of a bridge across the Ohio River at or near Cannelton, Perry County, Ind., having considered the same, report thereon with an amendment, and recommend that the bill as amended do pass.

The amendment is shown in italic in the bill as reported.

The bill has the approval of the War Department and the Federal Works Agency, as will appear by the following letters:

So far as the interests committed to this Department are concerned, I know of no objection to the favorable consideration of the accompanying bill, S. 3157, Seventy-sixth Congress, third session, to authorize the construction of a bridge across the Ohio River at or near Cannelton, Perry County, Ind. A minor correction has been indicated in red thereon.

This report was submitted to the Bureau of the Budget, which advised that there was no objection to its submission to the committee.

DEAR SENATOR BAILEY: Receipt is acknowledged of your letter of January 20, transmitting a copy of a bill (S. 3157) with request that the committee be furnished with such suggestions touching its merits and the propriety of its passage as this Agency might deem appropriate.

This bill would authorize the Indiana State Toll Bridge Commission to construct, maintain, and operate a bridge and approaches thereto across the Ohio

River, at or near Cannelton, Perry County, Ind. Said commission would be authorized to fix and charge tolls for transit over such bridge. The rates of toll to be charged for the use of the bridge would be required by section 4 of the bill to be so adjusted as to provide a fund sufficient to meet reasonable maintenance, repair, and operating costs and provide a sinking fund sufficient to amortize the cost of constructing the bridge and its approaches within a period of not to exceed 30 years from the date of completion of the bridge. After a sinking fund sufficient for such purpose shall have been provided, the bridge would have to be maintained and operated free of tolls.

The Indiana State Toll Bridge Commission is an agency of the State of Indiana and if the proposed bridge should be constructed it would be publicly owned and operated by the State. The bill, therefore, is without objection so far as this Agency is concerned.

Upon reference of this matter to the Bureau of the Budget, the Assistant Director thereof advised under date of February 16, 1940, that there would be no objection to the submission of this report to the committee.

The Committee on Commerce, to whom was referred the bill (S. 3570) to grant the consent of Congress to the Commonwealth of Pennsylvania to construct, maintain, and operate a free highway bridge across the Allegheny River at Port Allegany Borough, Liberty Township, in the county of McKean, and in the Commonwealth of Pennsylvania, having considered the same, report favorably thereon with amendments, and recommend that the bill as amended pass.

This bill would authorize the State of Pennsylvania to construct, maintain, and operate a free highway bridge and approaches thereto across the Allegheny River at Port Allegany, McKean County, Pa.

Favorable action on the bill is recommended.

This report has been referred to the Bureau of the Budget and that Bureau has advised that there would be no objection to its submission to the committee.

The Committee on Commerce, to whom was referred the bill (S. 2999) to legalize a bridge across Bayou Lafourche at Galiano, La., having considered the same, report favorably thereon without amendment with the recommendation that the bill do pass.

The bill has the approval of the War Department and the Federal Works Agency as will appear by the following letters:

DEAR SENATOR BAILEY: The Department is in receipt of your letter of November 1, 1939, requesting its views on the bill S. 2999, Seventy-sixth Congress, second session, entitled "A bill to legalize a bridge across Bayou Lafourche at Galiano, La."

Section 9 of the River and Harbor Act approved March 3, 1899 (30 Stat. 1151), provides that it shall not be lawful to construct or commence the construction of any bridge over a navigable water until the plans for such structure shall have been submitted to and approved by the Chief of Engineers and the Secretary of War. The bridge across Bayou Lafourche at Galiano, La., was constructed without the requisite approval of plans and consequently must be regarded as an unlawful structure.

The purpose of S. 2999 is to legalize the bridge by authorizing the Chief of Engineers and the Secretary of War to approve the location and plans thereof providing it affords reasonably free, easy, and unobstructed navigation, and declaring that upon such approval the bridge shall be deemed a lawful structure. So far as the interests committed to this Department are concerned, I know of no objection to the favorable consideration of S. 2999 by Congress.

This proposed report was submitted to the Bureau of the Budget which advises that there would be no objection on the part of that office to its submission to the committee.
