However it hath been effected in our days, for per 4 Anna, c. 16. fett. 21. All warranties fince the first day of Trinity-term Anno Dom. 1795. by any tenant for life, of any lands, tenements, or hereditaments, coming or defcending to any perfon in reverfion or remainder, are void and of no effect, and all collateral warranties made fince then, of any lands, tenements, or hereditaments, by any ancestor, who had no eftate of inheritance in poffeffion, the fame is void against the heir. Since our author wrote the law feems to be otherwise understood, for it is now the common practice for infants, having obtained a privy feal for that purpose, to fuffer common reco veries, and the law feems to have been fo fettled ever fince Blunt's cafe, which is reported in Hobart's Reports, pag. 196. which recovery was afterward held good on a writ of error brought, and infancy affigned for error, as may be feen in W.
