King, esq., late collector of the customs at San Francisco; and likewise of the adjustment thereof, if any, at the Treasury; and also of all the letters or communications to the President, or to the Treasury, or other Departments making complaints or charges against said King as such officer or while in said office; also a copy of the letters of said King relinquishing or resigning his said office prospectively, conditionally or otherwise, and of the notification of the acceptance thereof.

Ordered, That the Secretary lay the said resolution before the President of the United States.

MILLARD FILLMORE.

NAVY DEPARTMENT, January 4, 1853. SIR: I have to submit to you a nomination of William L. Nichol, of Tennessee, and John C. Coleman, of Virginia, to be assistant surgeons in the Navy, from the 28th of June, 1852.

These gentlemen were nominated during the last session of the Senate to fill vacancies, but their nominations were not acted on. Other assistant surgeons, who were before the Senate at the same time, were confirmed on the 28th of June, 1852, and were commissioned from that date.

Early in the present session Drs. Nichol and Coleman were renominated and were confirmed by the Senate on the 21st of December, but as no time was mentioned in their nominations from which they should take date as assistant surgeons their commissions, if issued, would have to date from the 21st of December, the day of their confirmation. This would throw them below assistant surgeons who were commissioned in the recess and since confirmed by the Senate, although they passed their examination for admission into the Navy above them and were nominated previously to them. To correct this a new nomination is submitted, giving to Drs. Nichols and Coleman the date of the assistant surgeous who were before the Senate at the time they were, and who were confirmed and commissioned on the 28th of June, 1852.
