For Regulating the Colours to be worn on
Merchants Ships.

Hereas by ancient ulage no Verchants Ship ought to bear the Jack, which is for diftincion appointed for his Majesty's Ships; nevertheless his Hajelty is informed, that Divers of his Hajcky's Subjeæs have of late prelumed to wear his Majesty's Jack on board their Ships employed in Herchants Affairs, and thinking to evade the Punishment due for the fame, bear Jacks in Shape and Hixture of Colours, Co little different from thole of his Majesty agnot to be without difficulty diftinguifht therefrom,which practice is found attended with manifold Inconveniencies ; Foz prevention whereof for the future his Majesty hath thought fit, with the Advice of his Privy Council, by this his Kopal

their to doing from his Majchy, o2 the Lozd high Admiral of England, 02 the Commiftioners for executing the Ece of Low High Admiral foz the time being; And his Majefty doch hereby further Command all his loving Subjects, that without fuch Warrant as afozefaid, they pzeltime not to wear on board their Ships oz Weffels, any Jacks made in imitation of his Majefty's, 02 any other Flags, Jacks, o2 Enfigns whatsoever, than those usually heretofoze won on Verchauts ships, viz. the Flag and Jack white, with a Red Cross, (commonly called Saint George's Cross) paffing quite though the fame; And the Enfian Red, with the like Crofs in a Canton White, ac the upper Cozner theresf next to the Staff.

And his Maicfty doth hereby require the principal Officers and Commiftioners of his Navy, Govern023 of his Forts and Caffles, the Officers of his Cuftoms, and Commanders 02 Officers of any of his Majefty's Ships, 02 upon their meeting with, or otherwile obferving any Merchants Ships 02 Wellels of his Majefty's Subjects wearing such a Flag, Jack, o Enfign, contrary hereunto, whether at Sea of in Post, not only to caufe fuch Flag, Jack 02 Enfign, to be forthwith Seized, bur to return the Names of the laid Ships and vellels, together with the Mames of their respeæive Mafters, unto

the Lord high Admiral, Lozds Commilfioners of the Aomiralty, oz the Judge of the High Court of Admiralty for the Time being, to the end the Persons offending may be duly punished for the fame.

Aud his Majeffy doth hereby command and enjoyn the Judge and Judges of the High Court of Admiralty for the Time being, that at the several Sessions to be hereafter held by his Majesty's Commiffion of Oyer and Terminer for the Admiralty, they give in Charge, that ftri& enquiry be made of all Offences in the Premises, and that they cause all oflenders therein to be duly Punished. And all iceAdmirals, and Iudges of Uice Admiralties, are allo to do the fame, and to attend the due Obfervation hereof, within the feveral Pots and Places of their respective Precinas.

Confervation, good Eftate, wholefome Government, Maintenance, and Encrease of the Navigation of this Kingdom; and of the Mariners, and Seafaring Men within the fame. By Virtue of several CHARTERS, and LETTERS PATENTS, made unto the faid Corporation by feveral KINGS and QUEENS of this Realm.

And particularly of a

Charter of Conftitution, and Confirmation of the fame, made by our most gracious Sovereign JAMES the Second, by the Grace of GOD, of England, Scotland, France, and Ireland, King, Defender of the Faith, &c. Dated the Eighth Day of July, in the First Year of His Majefty's Reign.
