CHAPTER 162.

AN ACT to provide for the examination of the

accounts of school boards.

The people of the state of Wisconsin, represented in

senate and assembly, do enact as follows:

SECTION 1. It shall be the duty of every Three tax payschool district in the state of Wisconsin at its accounts. To annual meeting to appoint three competent men,

report, wben. who shall be tax payers in the district, to examine all accounts, books, vouchers, moneys and property of whatever kind belonging to said distriet, between the first and fifth days of July of cach year and report the finding, in writing, at the next regular annual meeting.

SECTION 2. Said report shall be recorded in the school records, properly signed by the committee.

SECTION 3. All acts and parts of acts conflicting with this act are hereby repealed.

SECTION 4. This act shall take effect and be in force from and after its passage and publication.

CHAPTER 163.

AN ACT to appropriate a sum of money for the

further prosecution of the geological and natural history survey of the state.

The people of the state of Wisconsin, represented in

senate and assembly, do enact as follows:

Appropriation of $10,000 annually.

SECTION 1. There is hereby appropriated for the further prosecution of the Yeological and natural history survey, out of any money in the treasury not otherwise appropriated, the sum of ten thousand dollars annually for the term of two years. This money shall be expended by the commissioners of said survey for the purpose of executing the duties assigned to them by chapter 297 of the laws of 1897.

SECTION 2. This act shall take effect and be in force, from and after its passage and publication.

CHAPTER 164.

AN ACT to amend section 1121, of the Wiscon

sin statutes of 1898, relating to the collection and payment of taxes by county treasurers.

The people of the state of Wisconsin, represented in

senate and assembly, do enact as follows:

SECTION 1. Section 1121 of the Wisconsin Payment of statutes of 1898 is hereby amended by omitting state tax by therefrom the following words: "except that uniformade the treasurers of the counties of Douglas, Polk, Bayfield, Burnett, Marathon, Oneida and Ashland shall pay such taxes on or before the second Monday in July in each year.” Said section when so amended, shall read as follows: Section 1121. The several county treasurers shall pay to the state treasurer the amount of state taxes charged to their respective counties, on or before the first Monday of February in each year.

SECTION 2. This act shall take effect and be in force, from and after August 1st, 1899

SECTION 1. In any case, whether occurring heretofore or hereafter, where the common coun: cil

city incorporated by special act shall have undertaken and assumed to adopt in whole or in part the provisions of the general city charter law of this state, and such city and its officers shall have assumed thereafter in good faith to act under, and to exercise the powers conferred by, the provisions of law so assumed to be adopted, any question of the validity of such assumed adoption and of the ordinance and proceedings therefor may be tested by certiorari or by any other proper action or proceedings brought directly for the purpose of vacating or setting aside the same at any time within three months after such assumed adoption, but not thereafter; provided, that, as to all such cases occurring prior to the taking effect of this act, such direct action or proceeding may be commenced within three months after the passage and publication of this act, but not thereafter. No such assumed adoption nor any ordinance or proceeding for such adoption of the whole or any part of such general city charter law shall be in any manner called in question or held to be invalid in any action or proceeding except one brought directly for that purpose within the time hereinbefore limited therefor, unless the same shall have been duly vacated or set aside by a court of competent jurisdiction. The pro- i visions of this act shall in no manner affect pending actions.

SECTION 2. This act shall take effect and be in force from and after its passage and publication.

CHAPTER 166.

AX ACT to provide for the declaration of divi

dends of stock fire insurance companies and for increase of their capital stock in certain

(ases.

The people of the state of Wisconsin, represented in

senate and assembly, do enact as follows:

SECTION 1. Any stock fire insurance company Dividends of doing business or organized under the laws of ten per cent. this state may declare dividends not exceeding cland when ten per centum of its capital stock in any one clared conVear, if in addition to the amount of its capital visions of act stock, plus ten per centum of the capital stock, feitura of

charter. and of such dividends and all of its outstanding Tabilities, it shall have accumulated and be in possession of a lawful fund equal to the amount of all unearned premiums on risks not terminated at the time of making such dividend. No dividends in excess of said ten per cent. of its capital stock shall be declared until such corporation shall be in possession of a net surplus equal to one-half of its capital stock, which surplus in no erent shall be less than one hundred thousand dollars. Any dividend made contrary to the provisions of this section shall work a forfeiture of the charter of the corporation making such dividend, and each stockholder receiving such divi.
