AN ACT

To continue the Civil Aeronautics Board as an agency of the United States, to create a Federal Aviation Agency, to provide for the regulation and promotion of civil aviation in such manner as to best foster its development and safety, and to provide for the safe and efficient use of the airspace by both civil and military aircraft, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act, divided into titles and sections according to the following table of contents, may be cited as the "Federal Aviation Act of 1958":

1 Section 6(c)(1) of the Department of Transportation Act (Public Law 89-670, approved October 15, 1966; 80 Stat. 931) effective April 1, 1967, which appears at page 105 of this publication, transferred all functions, powers, and duties of the Federal Aviation Administrator and the Federal Aviation Agency to the Secretary of Transportation. Therefore, in accordance with a ruling of the General Counsel, Department of Transportation, this publication substitutes the words "Secretary of Transportation" for references to the Administrator, except where the context requires otherwise, and except for section 611 relating to noise abatement. The transfer to the Secretary is subject to the statutory requirement that the Administrator carry out the functions, powers, and duties of the Secretary relating to "aviation safety." The functions, powers, and duties previously exereised by the Civil Aeronautics Board under titles VI and VII of the Federal Aviation Act of 1958 were transferred by section 6(d) of the Department of Transportation Act to the National Transportation Safety Board established in the Department of Transportation, Section 3(e) (1) of the Department of Transportation Act also established the Federal Aviation Administration, headed by an Administrator, within the Department. These changes in the Federal Aviation Act of 1958, and in other statutes or Executive Orders, are indicated by appropriate footnotes to the provisions affected.
